Website Terms and Conditions (Purchased Items)
This document (the "Agreement") is a legal contract between you ("You") and PSALM, Inc. ("PSALM"). This contract governs your use of PSALM's online Liturgical Music Resource ("Service").

LICENSE OF CONTENT

You may download, view, copy, and/or print music, documents and graphics ("Compositions") on this Website under the following conditions:

1.	Your purchase of a license gives You a license to use up to five copies of the Composition.   If You use more than five copies, You must purchase an additional license or licenses to equal the usage.

2.	All attribution notations of the author or otherwise on the Composition must be kept on the Composition.

3.	You may not make changes to or create derivative works of the Composition.

When you pay for service from this Website, Your payment grants you the specific rights set forth in this Agreement. Any other use is strictly prohibited unless you pay for such rights to use it.
All fees collected are used to support PSALM, Inc., a not-for-profit corporation in the State of California, and to defray the costs connected with offering this Service, including, but not limited to, payment of royalties to the Author of the Composition(s) featured on this website.

USE OF LICENSED MUSIC 
If You license music under the scope of this license, You may use the print music, documents, and graphics based on the following conditions: (1) The Compositions may be used for liturgical, personal, informational, commercial (including performances) and non-commercial purposes. (2) The Compositions will not be modified or altered in any way without the specific written permission of the author, composer, licensor, publisher, hired agent representing them or exclusive web-based agreement for such a Composition. (3) You agree that You will credit the composer in any commercial or performance use of the material.  If you wish to record the Composition and sell the recording, you must separately obtain "mechanical rights" from the composer.

WEB SITE CONTENT COPYRIGHT
You agree that you will not in any way violate the copyright of any information contained on this Website. If you license a Composition from PSALM, You may not transfer the licensed work to any third party without the written permission of PSALM.

SECURITY AND PRIVACY

Certain services and special features offered on this Website require that you open an account, which requires that you set up an ID and Password.  It is your sole responsibility to protect the confidentiality of your account information, including your password and any activity or purchasing that takes place under your account. You agree to notify PSALM of any unauthorized use or activity on your account immediately. However, PSALM will not accept responsibility for a breach or violation of your security due to your negligence.

You may not, at any time, use someone else's ID, Password, or Payment method on this Website. PSALM shall in no way be liable for loss or damage as it relates to your account due to your failure to comply with these regulations.

PRIVACY

PSALM's Privacy Policy is made part of this Terms and Conditions Agreement. Additionally, by using this Website, you agree that Internet transmissions are never totally private or secure. You understand that any message or information you send to the Site may be intercepted or viewed by a third party, even if notice is given that such a transmission (such as financial information) is encrypted.

WARRANTY DISCLAIMER

PSALM does not promise that the Site or anything on this Site, such as services or features, will be error free or uninterrupted, or that any defects will be corrected, or that your use of the Website will produce definite results.  You understand that services on this Website may be rendered on an "as-is" and "as-available" basis.  All information that we place on this Website is subject to change without notice.  PSALM cannot guarantee that products you download from the Website will be free of viruses or contaminating and destructive features.  PSALM disclaims all warranties, express or implied, of any sort.  PSALM disclaims any and all liability for the conduct of any third parties in connection with or related to your use of the Website and/or any of its services. You accept total complete responsibility for your use of the Website and any sites linked.

LIMITATION ON DAMAGES

Other than where prohibited by law, in no event will PSALM be liable to you for any consequential, indirect or incidental damages.

LIMITATION OF LIABILITY

The maximum liability of PSALM under this Agreement will not exceed the amount paid for licenses for Compositions.

VIOLATION OF THIS AGREEMENT

Violation of this agreement in any form may result in the revoking of all privileges you have on this Website, without your immediate notification.

ACCEPTANCE OF THIS AGREEMENT

By using orthodoxpsalm.org (the "Website") you agree to adhere to and be bound by this Agreement.  You represent that you are over the age of 18, and can legally make such a decision. You agree that unless specifically authorized by this Agreement, you have no right to use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit, or distribute any information from this Website in whole or in part without the written permission of PSALM.

This Agreement supersedes all prior and contemporaneous agreements, representations, warranties and understandings, whether written or oral, with respect to the Website, as well as its contents and services.  Please review this Agreement carefully and on a regular basis, because you are liable for your violation of this Agreement.

PSALM reserves the right to: (1) modify, terminate, or suspend operation of or access to the Website or the Service, or any portion for any reason; (2) to modify the Website or any portion of the Website and applicable terms and policies; and (3) to delay or interrupt the operation of the Website, or any portion of the Website, as necessary to perform maintenance or other changes to the Website, whether they be random or scheduled.
